Michigan Supreme Court Order FAQs Aim to Clarify Court Record Access
As previously communicated, the Michigan Supreme Court amended Michigan Court Rule 1.109 allowing authorized individuals to obtain access to individual court records, provided that certain ID requirements are met.
The requirements to register authorized personnel to obtain court records became effective on April 1, 2022.
Some courts have been interpreting Rule 1.109 differently, either requiring in-person access or limiting the number of times records can be accessed per day. Recently, the State Court Administrative Office (SCAO) released an FAQ that addresses some concerns around gaining access to court records. Most importantly, the FAQ clarifies that verification does not need to be done in person.
Despite certain Michigan courts implementing this rule differently, Certiphi continues to operate and perform searches in these area, working with court clerks to ensure MI court records can be accessed.
