Alabama Establishes Elder Abuse Registry and Query Requirement
Signed on March 24, 2022 by Alabama Governor Kay Ivey, the Act - also known as "Shirley's Law" - establishes the creation of a statewide elder abuse conviction registry.
The Alabama Department of Human Resources will maintain this registry, known as the Alabama Elder and Adult in Need of Protective Services Abuse Registry. It will contain the name, last known mailing address, offenses, and any other information the agency determines is necessary to positively identify individuals with prior convictions of elder abuse.
Effective June 1, 2022, employers of care providers who work directly with vulnerable adults will be required to query the registry for their current and prospective employees. The goal is to ensure the employment of individuals with no history of elder abuse and protect the safety of a very vulnerable population.
Acts of abuse may include emotional abuse, exploitation, financial exploitation, intimidation, neglect, sexual abuse, or undue influence against an elderly individual.
Certiphi Screening has reached out to the Alabama Department of Human Resources, who advised that this registry's establishment is still in process. Once this registry is available, Certiphi will further explore our capability to utilize this service for our healthcare clients.
