New York Clean Slate Act: Changes to Criminal Record Sealing and Reporting
Effective November 16, 2024, New York State will implement the Clean Slate Act, automatically sealing eligible misdemeanor convictions three years after sentencing and felony convictions after eight years.
The sealing process will take up to three years to complete, with exceptions for most Class A felonies, murder, and sex offenses. Individuals must not be on parole, probation, or have any pending criminal cases for records to qualify.
Certiphi's reporting practices already align with the requirements of the New York Clean Slate Act and the Consumer Financial Protection Bureau (CFPB) advisory opinions. Our current reports exclude records eligible for sealing under the new law. We do not expect any delays in processing times for county-level background checks as a result of this legislation.
