Criminal records checks must still be requested within five business days of an individual beginning conditional employment. Previously, employers were required to terminate employment if background check results were not received within 30 days of the request. SB 144 extends this period to 60 days.

The bill does not change the requirement for immediate termination if the results reveal disqualifying offenses, regardless of when records are received. Disqualifying offenses include convictions or guilty pleas to crimes such as assault, failure to provide for a functionally impaired person, corruption, drug-related charges, and others - outlined in full within Ohio Revised Code Section 109.572.
