Nebraska Legalizes Medical Cannabis
Nebraska has officially legalized medical cannabis following the passage of ballot measures 437 and 438 in the November 2024 election.
The law does not immediately permit the purchase of medical cannabis within the state. The newly established Nebraska Medical Cannabis Commission has until July 1, 2025, to draft regulations, with licensing set to begin by October 1, 2025.
Much like Kentucky's legalization of medical cannabis, Nebraska's legalization allows employers to continue drug testing and enforce zero-tolerance policies. Employers are not required to permit medical cannabis use, possession, or impairment at work, and existing drug-free workplace policies remain enforceable. The law does not provide employment protections or require workplace accommodations for medical cannabis users.
Nebraska employers should review their policies for compliance with business needs and clearly communicate workplace expectations regarding cannabis use.
