Eligible offenses include petty misdemeanors, misdemeanors, and certain nonviolent felonies after a waiting period, provided the individual has not committed new offenses. More serious crimes, such as offenses requiring predatory offender registration, are not eligible for expungement. The Bureau of Criminal Apprehension (BCA), responsible for expunging records, has encountered delays due to testing challenges. Once testing and system updates are complete, the Minnesota Judicial Branch will have 60 days to review the records before automatic expungements begin in mid-May 2025.

Once expunged, these records will no longer be reportable by Consumer Reporting Agencies or visible to most employers. Certain agencies, such as law enforcement and licensing boards, will still have access to expunged records.

Employers should review their hiring policies to ensure compliance with the new restrictions on accessing and considering expunged records.
